Terms of Service

These Terms of Service ("Terms") govern your use of the mobile apps published by Visualisedata Pty Ltd ("we", "us"), including Data Quiz, Music Quiz and Maths Quiz (each, the "App"). By downloading or using an App you agree to these Terms. If you do not agree, please do not use the App. Questions? Contact chris@visualisedata.com.au.
Eligibility & accounts
You may sign in with Google, Apple, or an email address to save your progress and take part in leaderboards. You are responsible for activity under your account and for keeping your sign-in secure. If you are under the age of majority where you live, a parent or guardian should agree to these Terms and set up and supervise your use of the App.
Licence to use the App
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for your own non-commercial entertainment, subject to these Terms and the rules of the app store you downloaded it from.
Acceptable use
- Don't cheat, exploit bugs, automate play, or manipulate scores, leaderboards, coins, or rewards.
- Don't reverse-engineer, tamper with, or interfere with the App or our systems.
- Don't use the App unlawfully or to infringe anyone's rights.
- Keep any display name you set appropriate — no offensive, misleading, or infringing names.
Virtual coins
The App may award or let you spend virtual "coins" and similar in-game items. Coins have no monetary value, are not your property, and cannot be redeemed, exchanged, transferred, or cashed out for real money or anything of value outside the App. They are a licence to a feature of the game. We may adjust, expire, or remove coins and in-game items, and change how they work, at any time. Coins are not a bank deposit, e-money, or a payment instrument.
In-app purchases
Some Apps offer a paid option (for example, removing ads). Purchases are processed by Apple or Google under their terms — we do not receive your card details. Prices are shown before you buy. Refunds are handled by Apple or Google according to their policies; we generally cannot issue refunds directly. A purchase such as "remove ads" applies to the account/store account that made it.
Leaderboards & fair play
Leaderboards and rankings are provided for fun. We may recalculate, reset, or remove entries, and we may void scores or suspend accounts we reasonably believe were achieved by cheating or in breach of these Terms.
Content & intellectual property
The App, its questions, design, and branding are owned by us or our licensors and are protected by law. You may not copy, distribute, or create derivative works from them except as allowed by these Terms or applicable law. If a question appears to be inaccurate you can report it in the App, and we may review, edit, or remove content at our discretion.
Suspension & termination
You can stop using the App and delete your account at any time from within the App (Settings → Delete account). We may suspend or terminate your access if you breach these Terms or misuse the App. On termination, your licence ends and virtual coins and items are forfeited.
Disclaimers
The App is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not guarantee the App will be uninterrupted, error-free, or that content is complete or accurate. Nothing in these Terms excludes rights you have under mandatory consumer protection laws (including the Australian Consumer Law), which apply in addition to these Terms.
Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential losses, or for loss of data, coins, or progress. Where liability cannot be excluded but can be limited, our total liability is limited to the amount you paid us (if any) for the App in the 12 months before the claim.
Changes
We may update the App or these Terms from time to time. Material changes to the Terms will be reflected by the "Last updated" date above; continued use after a change means you accept the updated Terms. We may also modify or discontinue features, including virtual coins and in-game items.
Governing law
These Terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that State, without limiting any mandatory consumer rights in your country of residence.
